BOGUE — Bogue Sound Distillery has filed a lawsuit against the Town of Bogue that alleges the planning board violated the state’s Open Meetings Law related to a meeting and vote taken that denied a special-use permit for the business to offer outdoor entertainment.
The claim, filed on behalf of CVASC, LLC and Bogue Sound Distillery, Inc., owned by Richard Chapman, was filed in Carteret County Superior Court in Beaufort on May 29. The suit lists the Town of Bogue, the Town of Bogue Planning Board, and Robert O’Chat, in his official capacity as co-chair of the planning board and town mayor.
